The first part of the contribution identifies the limits of Italian constitutional justice with regard to the modulation by the Constitutional Court of the temporal effects of its upholding judgments. The second part attempts to formulate some operational proposals that would enable the Constitutional Court – with unchanged positive law – to safeguard the specific real and pressing needs of constitutional importance that, in individual cases, it could not protect except by limiting the retroactivity for the past of its pronouncement or even deferring its effects into the future.
