The protection of animals in the new Article 9 of the Constitution [La tutela degli animali nel nuovo articolo 9 della Costituzione]

The paper, based on a pro-veritate legal opinion, considers the position of animals with particular reference to the amended Article 9 of the Constitution. The third paragraph, last period, of the said Article, as introduced by Constitutional Law No. 1 of 2022, where it states that “The law of the State regulates the ways and forms of protection of animals”, does not contain a rule on the assignment of normative power neither between primary and secondary sources, nor between state law and regional law. Instead, it is a provision that indicates to the national legislature the direction to follow, without this excluding that both regional legislators and other public authorities follow the same direction. In this sense, it can be said that the new constitutional provision contains nothing but a pressing invitation – the indicative verb is as always to be understood in a prescriptive sense – specifically directed to the national legislature to give concrete implementation to a new fundamental principle – the animalist principle – today contained in the text of the Constitution, and therefore endowed with the force of the highest-ranking positive law.

Lo scritto, tratto da un parere pro veritate, prende in considerazione la posizione degli animali con particolare riferimento al modificato art. 9 della Costituzione. Il terzo comma, ultimo periodo, dell’art. 9 Cost., introdotto dalla legge costituzionale n. 1 del 2022, là dove dispone che «La legge dello Stato disciplina i modi e le forme di tutela degli animali», non contiene una norma sulla distribuzione del potere normativo né tra fonti primarie e secondarie, né tra legge statale e legge regionale. Si tratta, invece, di una disposizione che indica al legislatore statale la direzione da percorrere, senza con questo escludere che i legislatori regionali o gli organi della pubblica amministrazione seguano la medesima direzione. In questo senso, si può dire che la nuova disposizione costituzionale non contiene altro che un pressante invito – il verbo all’indicativo è come sempre da intendere in senso prescrittivo – specificamente rivolto al legislatore statale a dare concreta attuazione a un nuovo principio fondamentale – il principio animalista – oggi contenuto nel testo della Costituzione, e quindi dotato della forza del diritto positivo di rango più elevato.
