The applicability of the consumer protective discipline to the condominium has long been discussed. The issue was the subject of a recent ruling by the Court of Justice (2 April 2020, n 329) and is today particularly interesting in consideration of the tax relief introduced by the Revival Decree (so-called Superbonus), which raised the rate up to 110% for the deduction of expenses incurred for specific restructuring and efficiency improvements of the buildings. The massive bargaining resulting from these regulatory interventions leads the jurist to wonder if and under what conditions the condominium can enjoy consumer protection, and, especially with regard to the “construction contract”, how the quality of consumer affects the negotiation, the determination of the contractual content and on the protections granted to the weak party of the contractual relationship.
Da tempo si discute della applicabilità al condominio della disciplina protettiva del consumatore. Il tema è stato oggetto di una recente pronuncia della Corte di Giustizia (sentenza 2 aprile 2020, n 329) e trova oggi un rinnovato interesse in considerazione degli sgravi fiscali introdotti dal Decreto rilancio (c.d. Superbonus), che ha elevato al 110% l’aliquota di detrazione delle spese sostenute per specifici interventi di ristrutturazione ed efficientamento degli immobili. La massiccia contrattazione conseguente a tali interventi normativi induce a domandarsi se e a quali condizioni il condominio possa godere della tutela consumeristica, e, specie con riguardo al contratto di appalto, come influisca la qualità di consumatore sulla negoziazione, sulla determinazione del contenuto contrattuale e sulle tutele accordate al soggetto debole del rapporto.
