Modern challenges within the law of State responsibility for human rights violations committed by non-state actors: special focus on business activity

The present paper addresses the problem of human rights violations perpetrated by business enterprises under the lens of the law of State responsibility. To this end, it explores the current challenges faced by international law in this realm from the two-fold perspective of the State’s positive obligation to respect, and negative obligation to protect, human rights, with a special focus on the latter.

Il presente saggio affronta il problema delle violazioni dei diritti umani perpetrate dalle imprese alla luce della normativa in materia di responsabilità dello Stato. A tal fine, le attuali sfide affrontate dal diritto internazionale in tale ambito verranno analizzate nella duplice prospettiva dell’obbligo positivo dello Stato di rispettare i diritti umani e, soprattutto, di quello negativo di proteggere gli stessi.
