Just few days to the Constitutional Court decision on "spring suspension". To save the unfavorable nonretroactivity principle, the author proposes a different reconstruction of the system inspired by the principle of legality, the leading case of the Sezioni unite and, above all, a correct balance of constitutional values that does not force the accused to pay for the inefficiency of the State.
