The paper analyzes some topics, in particular the characteristics of the fundamental right to health (art. 32, Cost. It.). The focus will bel given, with bioethics and theoretical legal tools, to the relationship between the rights of the legal system in these times of serious economic and social crisis and the shortage of resources allocated to the implementation of these rights. The analysis will help to show some of the problems of today and the new critical issues that could occur tomorrow, especially for the conditions and guarantees of a fundamental right among the most important
