Limiti soggettivi del giudicato di annullamento degli atti generali delle Autorità di regolazione

The paper aims to address a very significant problem in the practice of the Regulatory Authorities, namely the subjective limits of the res judicata by which the administrative judge quashes general acts. In the first part, after recalling the conceptual framework of the extension of the subjective effects of res judicata, the paper present an overview of case law about Tariff Acts of the Italian Authority for electricity gas and water services (Autorità per l’energia elettrica il gas e i servizi idrici) in order to highlight the characteristics of this specific category of regulating acts. The second part of the paper highlights the unresolved problematic issues, considering the appropriateness of rationalizing the appeals of this particular category of acts.
