Law n. 2013-404 provides gay marriage in the French legal system. Due to the lack of a conscience clause, a judiciary case was started by a group of mayors. Is it possible to recognize conscientious objections for people fulfilling public functions? May we point out some general requirements for the legal provision of a conscience clause? With reference to Italy, which is the relation between the legal protection of conscience and people’s opinions?
