This chapter examines the relationship between the international law governing the threat or use of force and international organizations. It focuses on three dimensions of this relationship. First, it considers whether international organizations are themselves bound by the prohibition of the threat or use of force, arguing that, despite the wording of Article 2(4) of the Charter of the United Nations, the customary rule reflected therein may apply to international organizations as subjects of international law. Second, it distinguishes between the use of force by an international organization and the use of force through an international organization. This distinction is particularly relevant to the attribution of conduct and the determination of responsibility, especially where military personnel are provided by Member States. The chapter examines the role of effective control in this context and considers the different arrangements through which the United Nations and regional organizations may authorize, coordinate, or directly conduct military operations. Third, it explores the possibility that international organizations may themselves be victims of unlawful uses of force and may consequently invoke the international responsibility of States or other international organizations. It considers, in this regard, the protection of an organization’s personnel, premises, and assets, as well as its capacity to invoke responsibility and, in certain circumstances, adopt countermeasures. The chapter concludes that, although international organizations may occupy both active and passive positions in the legal relationship arising from the prohibition of the use of force, the allocation of responsibility remains highly dependent on the institutional and factual circumstances of each case, particularly the degree of effective control exercised over military operations.

Il capitolo esamina il rapporto tra le norme del diritto internazionale che regolano la minaccia e l’uso della forza e le organizzazioni internazionali. L’analisi si articola lungo tre dimensioni. In primo luogo, viene esaminata la possibilità che le organizzazioni internazionali siano esse stesse destinatarie del divieto della minaccia e dell’uso della forza, sostenendo che, nonostante la formulazione dell’articolo 2, paragrafo 4, della Carta delle Nazioni Unite, la norma consuetudinaria ivi riflessa possa trovare applicazione anche nei confronti delle organizzazioni internazionali in quanto soggetti di diritto internazionale. In secondo luogo, il capitolo distingue tra l’uso della forza da parte di un’organizzazione internazionale e l’uso della forza attraverso un’organizzazione internazionale. Tale distinzione assume particolare rilievo ai fini dell’attribuzione della condotta e dell’individuazione della responsabilità, soprattutto nei casi in cui le forze armate siano messe a disposizione dagli Stati membri. A questo riguardo, viene analizzato il criterio del controllo effettivo e vengono esaminate le diverse modalità attraverso cui le Nazioni Unite e le organizzazioni regionali possono autorizzare, coordinare o condurre direttamente operazioni militari. In terzo luogo, viene considerata la possibilità che le organizzazioni internazionali siano vittime di un uso illecito della forza e possano, di conseguenza, invocare la responsabilità internazionale di Stati o di altre organizzazioni internazionali. In tale prospettiva, il capitolo esamina la protezione del personale, delle sedi e dei beni dell’organizzazione, nonché la sua capacità di invocare la responsabilità e, in determinate circostanze, di adottare contromisure. Il capitolo conclude che, sebbene le organizzazioni internazionali possano assumere tanto una posizione attiva quanto una posizione passiva nel rapporto giuridico derivante dal divieto dell’uso della forza, l’attribuzione della responsabilità rimane fortemente dipendente dalle circostanze istituzionali e fattuali di ciascun caso, e in particolare dal grado di controllo effettivo esercitato sulle operazioni militari.
