In the current context, marked by the crisis of international law and the growing contestation of fundamental rights even within well-established democratic systems, the protection of rights has once again become a central concern of contemporary constitutionalism. Faced with real or perceived threats, democratic states increasingly resort to constitutional amendment in order to strengthen or “entrench” guarantees that are regarded as established but nonetheless vulnerable. These interventions often display a predominantly symbolic dimension: rather than introducing genuinely new forms of protection, they seek to make explicit rights, principles, or values that are already embedded in the constitutional order. This article critically examines this trend, exploring the relationship between the symbolic and the normative functions of constitutional amendment and questioning its actual capacity to enhance the protection of rights.
Nel contesto attuale, segnato dalla crisi del diritto internazionale e dalla crescente messa in discussione dei diritti fondamentali anche all’interno di ordinamenti democratici consolidati, la loro protezione torna a rappresentare uno dei nodi centrali del costituzionalismo contemporaneo. Di fronte a minacce reali o percepite, gli ordinamenti democratici ricorrono sempre più frequentemente alla revisione costituzionale per rafforzare o «cristallizzare» garanzie ritenute ormai acquisite, ma avvertite come vulnerabili. Tali interventi assumono spesso una marcata dimensione simbolica: più che introdurre nuove forme di tutela, mirano a rendere espliciti diritti, principi o valori già ricavabili dall’ordinamento costituzionale. Il contributo analizza criticamente questa tendenza, interrogandosi sul rapporto tra funzione simbolica e funzione normativa della revisione costituzionale e sulla sua effettiva capacità di rafforzare la tutela dei diritti.
