In contexts of healthcare poverty, health insurance policies are becoming increasingly widespread, despite the universality of the National Health Service. Such contracts are now subject to the integration of remote monitoring technologies for data collection, aimed at grounding the agreement on a “pay as you live” logic and a premium narrative. The essay examines the legal profiles of so-called Data Driven Contracts in the InsurTech sector, in light of contract law, the European Digital Data Acquis, and fundamental rights.
In contesti di povertà sanitaria, si diffondono assicurazioni sanitarie, nonostante l’universalità del SSN. Tali contratti subiscono ora l’integrazione di tecnologie di monitoraggio remoto per la raccolta dati, per fondare il patto sulla logica “pay as you live” e sulla narrativa premium.
