La transizione dalle aree non idonee alle aree idonee tra ambiziosi obiettivi europei e cauta legislazione domestica

The paper analyzes the challenging transition from the identification areas not suitable for the installation of renewable energy power plants (art. 12 of Legislative Decree No. 387 of 2003) to the determination of suitable areas (art. 20 of Legislative Decree No. 199 of 2021), in light of the achievement of renewable energy development targets set at the EU level. It also examines the decisive role played by the Regions in this process, to whom the national legislation has delegated - together with few binding criteria - the tasks of planning.
