This article examines a recent ruling by the Ordinary Court of Trieste, No. 1025 of December 5, 2025, concerning the recognition of filiation with respect to the intended parent in the con-text of assisted reproductive technology (ART) procedures carried out abroad, where such parent has died before the legal relationship with the child has been formalized. In particular, the focus is on the innovative aspects of the decision which, in line with the orientation of constitutional case law, aims to identify the most appropriate methods to ensure that children born through ART in Italy are swiftly recognized as having the full set of rights and duties inseparably linked to parental responsibility, in favor of those who participated in the reproductive project
