The Court of Cassation has once again ruled on the manner in which a request for questioning must be formulated pursuant to art. 415-bis paragraph 3 of the Code of Criminal Procedure, reiterating the principle that such a request must comply with the “ethical” criteria of fairness and procedural integrity. The request for questioning, which serves a protective function, cannot be considered as falling within the civil law concept of abuse of process. The Criminal Procedure Code, in fact, does not allow moralistic controls on the strategies chosen by the defence lawyer, limiting itself to imposing compliance with the rules of the “game” as boundaries within which the trial must take place.
La Corte di cassazione è tornata a pronunciarsi sulle modalità di formulazione della richiesta di interrogatorio ex art. 415-bis, co. 3 c.p.p., richiamando il principio secondo cui essa debba rispettare il criterio “etico” di lealtà processuale. In questo senso, la richiesta di interrogatorio presenta chiare finalità garantistiche che risultano inconciliabili con la categoria civilistica dell’abuso del processo. Il codice di rito, invero, non ammette controlli sulle strategie scelte dal difensore, limitandosi ad imporre il rispetto delle regole del “gioco” quali confini entro cui debba realizzarsi l’agone processuale.
