This paper analyzes three main contributions by the Italian analytical legal philosopher Uberto Scarpelli to a theory of customary law. In particular, it is investigated the role of language, of normative will, and of interpretation in the determination of customary legal norms. In the second and in the third part of the paper the author gives an original account of the role of the many different forms of reaction to the violation of a norm for inferring a norm from behavior, and the concept of "nomotrophic behavior" is proposed.
