Riflessioni sulla responsabilità dei c.d. hosting providers tra enforcement privatistico e regolazione amministrativa

The paper analyses the liability of so-called hosting providers for illegal information placed on the web by users. After illustrating the fundamental stages of relevant legislation and case law, the author reflects on the main legal problems raised by the traditional private enforcement instruments and on the possible solutions offered by the new European framework (Digital Service Act) in the context of the administrative regulation of «private powers».
