La "protezione civile"

Twenty years after the reform of the Title V of the Constitution, this article examines the division of competences between State and Regions for “civil protection”. Formally, this matter was a shared competence, but especially with pandemic it became totally under state jurisdiction. Today, in this matter with permeable and uncertain boundaries, Regions have formally a legislative competence, but essentially they exercise only administrative tasks.

A vent’anni dall’entrata in vigore della riforma del Titolo V della Costituzione, il contributo si sofferma sulla ripartizione delle competenze tra Stato e Regioni in materia di “protezione civile”, che da competenza concorrente si è progressivamente spostata sempre più verso il centro, specialmente nel periodo della pandemia. In questa materia dai confini sempre più sfumati e incerti, oggi le regioni esercitano delle potestà soltanto formalmente legislative, ma sostanzialmente amministrative.
