The paper deals with legal remedies for ‘continuing contracts’ affected by supervening events, in the setting of the current Covid-19 pandemic. Preference is given to renegotiation, meant as a legally enforceable obligation. In support of this theory some examples of comparative law and some references coming from sources of lex mercatoria are then given, which militate in favour of considering the logical-legal priority of renegotiation over the discharge of the contract.
