This contribution examines a recent case of marine pollution provoked by the discharge of hydrocarbons from a shipwreck located in a port area. The discharge, confined to a limited area of water by two containment rows that made it possible the suction, was considered by the GUP of the Court of Ravenna as not sufficient to integrate the crime of environmental pollution, but rather constituted the mildest violation of the provision on negligent pollution provided for by art. 9 d.lgs. 202/2007. This article focuses on the logical and legal process that led the Court to exclude the crime of environmental pollution, as well as on the nature of crimes of intentional and negligent pollution caused by ships and their relevance in the event of a spill resulting from a shipwreck.
L’articolo esamina un recente caso di inquinamento marino dovuto allo sversamento di idrocarburi derivanti da un relitto navale sito in area portuale. Lo spandimento, confinato in una limitata superficie d’acqua da due fila di panne di contenimento che ne hanno permesso l’aspirazione, è stato ritenuto dal GUP del Tribunale di Ravenna non sufficiente a integrare la fattispecie delittuosa di inquinamento ambientale, bensì la più mite contravvenzione di inquinamento colposo prevista dall’art. 9 d.lgs. 202/2007. Il contributo si sofferma sull’iter logico giuridico che ha portato il Giudice a escludere il delitto di inquinamento ambientale, nonché sulla natura delle fattispecie di inquinamento doloso e colposo provocato da navi e sulla loro applicabilità in caso di immissioni derivanti da un relitto navale.
