Una rilettura della figura del responsabile del procedimento dal punto di vista dell’illecito erariale

The paper offers a rereading of the officer in charge of the administrative procedure on the light of his administrative liability, in order to enhance the per-sonal implications of the dysfunctions of the administrations, beyond the screen of the legal personality of public authorities, and to evaluate the possible impact of the qualification of officer in charge of the administrative procedure for the assessment of the administrative liability. Specifically, after analyzing the jurisprudence of the Court of auditors on the administrative liability of the officer in charge of the administrative procedure and the typified cases of administrative liability, the paper ends with an analysis of the relationship between the officer in charge of the administrative procedure and the organ with competence for adoption of the final administrative act, also in order to em-phasize the liability of the latter.
