ASSET DISTRIBUTION UNDER THE LEGAL COMMUNITY REGIME: A DIFFERENT INVESTIGATION PERSPECTIVE [DISTRIBUZIONE PATRIMONIALE NEL REGIME DELLA COMUNIONE LEGALE: UNA DIVERSA PROSPETTIVA D'INDAGINE]

The natural evolutionary tendency of the spouses' patrimonial interests - as they have progressed in historical and social evolution and axiologically protected - constitutes the key to interpreting the code system in the sense of maximum extensibility and flexibility of the regulatory body to allow the development of the property of the single spouse. The study at the legal level of the regime of legal communion between spouses has led to the finding that the system of rules of communion cannot be separated from a correct framing within the prism of constitutional principles which, however, must be reread in the light of evolution of patrimonial relationships within the family.
