Le implicazioni giuridiche del nuovo paesaggio religioso: i soggetti collettivi e il diritto a un luogo in cui riunirsi

The recent Italian administrative case law reveals the presence of a "new" religious landscape composed of newly-forming groups, often poorly organized and not always falling within a broader religious confession, known and historically present in the territory. These groups escape the legal framework traditionally provided for in this specific sector and, indeed, at the moment they have no legal regulation at all. They are increasingly applying to the competent authorities to have a place available where they can meet to pray, but also to carry out many other activities. The case law reveals that the outcome of these applications is, at times, adversely affected by the existence of a religious and worship purpose.
