Through the analysis of the recent case-law of the CJEU (in particular SpaceNet, VD e SR, G.D., La Quadrature du Net, Privacy International, Schrems II, B. v. Latvia and B.K. v. Slovakia) the present article aims at better understanding the scope and meaning of Article 4, par. 2, TUE. On that basis, it assesses if, and to which extent, EU law – and in particular EU data protection law (GDPR and e-privacy directive) – can affect the activities of Member States in the field of national security.
