On November 26, 2021, the Italian Parliament approved an enabling law setting forth the principles and criteria of the civil proceedings and ADR reform. Among the subjects, the bill of law envisages significant innovations in the field of family justice, which include at the procedural level the creation of a unified proceeding called “proceeding concerning persons, minors and families” applicable to almost all judicial matters related to the status of persons, children and families, which currently fall within the competence of the ordinary court, the juvenile court and the tutoring judge. In such proceeding, time limits are introduced for matters over which the parties have the right of disposal; in all other cases, the judge is granted a wide range of ex officio powers.
