According to a case law developed by the Tribunal of Milan, which is rooted in the majority of doctrinal views, in presence of a delegation of functional powers concerning environmental issues from high-level employees to a third person, such a delegated person is to be considered in turn, and within the limits of the environmental sector to which the delegated powers refer, as an high-level employee under Art. 5, para. 1, letter a) of the Legislative Decree 231/01. Building on the above-mentioned case law, this manuscript analyzes the consequences of a delegation of functional powers concerning environmental issues on the rules of attribution under Art. 5, highlighting several critical drawbacks of the currently applied criterion, as well as attempting to establish an alternative interpretative key.
L’orientamento delineatosi in seno al Tribunale di Milano, sulla scorta della dottrina maggioritaria, afferma che, in presenza di una delega di funzioni in ambito ambientale idonea a trasferire poteri ab origine spettanti al delegante apicale, il delegato vada considerato a sua volta, per il settore ambientale, soggetto apicale ex art. 5, co. 1, lett. a) del d.lgs 231/01. Il contributo, partendo dalla pronuncia in commento, analizza l’incidenza della delega di funzioni in materia ambientale sul parametro di imputazione previsto dall’art. 5, rappresentando talune criticità applicative dell’attuale criterio ermeneutico e tentando di fornire una chiave interpretativa alternativa.
