Il collegio di elezione del Presidente della Repubblica nell’era post l. cost. n. 1/2020. I delegati regionali e la loro maggior incidenza numerica: equilibri da correggere?

The target of the work is to take into consideration the proposal of the constitutional law n. 2238, particularly, the art. 2, that implies the reduction of the regional delegates to elect the President from the current three to two for each region, following the reduction of the number of the parliamentarians (during the commitee review of the considered proposal, the constitutional law n. 1/2020 was approved indeed). Nevertheless, on one hand, such operation does not appear needed, considering the exiguity of the number and the irrelevant effect of the delegates, on the other hand it causes a few problems. Last but not least, the possibility to keep the principle of the election of the delegates on behalf of the Regional Councils “so that the representation of the minorities is assured”. This method would imply the designation of one delegate for the majority and one for the minority not considering the principles of democratic representativeness.
