La normativa sull'immigrazione del Friuli Venezia Giulia al vaglio della Corte Costituzionale: verso il repetita iuvant?

The paper aims to analyze the appeal filed by the Government against the Regional Act n. 9 of 2019. Pending a ruling by the Constitutional Court, this analysis provides an opportunity to reflect on two preliminary questions known by scholars and Constitutional jurisprudence. The first question concerns the division of competences between the State and the Regions in the field of immigration law after the reform of Title V of the Constitution and, in particular, the interpretation given by the Constitutional Court. The second question has as its object the analysis of the evolution of the legislation on immigration of Friuli Venezia Giulia; making a comparison between the legislation in force today, i.e. the Regional Act n. 31 of 2015, and the previous regional legislation, is intended both to describe the context in which the amendments of the Regional Act n. 9 of 2019 fit, and to understand how the changes intervened in the regional and national political framework influenced the normative and administrative choices.

Lo scritto intende analizzare il ricorso promosso dal Governo nei confronti della l.r. n. 9 del 2019. In attesa che la Corte costituzionale si pronunci, tale analisi fornisce l’occasione per riflettere su due questioni conosciute a dottrina e giurisprudenza costituzionale. La prima questione concerne il riparto di competenze tra Stato e Regioni in materia di diritto dell’immigrazione dopo la riforma del Titolo V della Costituzione e, in particolare, l’interpretazione datane dalla Corte costituzionale. La seconda questione ha quale oggetto l’analisi dell’evoluzione della normativa sull’immigrazione del Friuli Venezia Giulia; compiendo un confronto tra la normativa oggi in vigore, ovvero la l.r. n. 31 del 2015, e la precedente, si intende sia descrivere il contesto nel quale si inseriscono le modifiche della l.r. n. 9 del 2019, sia comprendere quanto i mutamenti intervenuti nel quadro politico regionale e nazionale abbiano influito sulle scelte normative ed amministrative.
