Le due sentenze dell’Adunanza plenaria… le gemelle di Shining?

The Twin Decisions of the Plenary Session of the Italian Council of State… The Twins from The Shining? The essay critically observes that the twin decisions of the Plenary Session of the Italian Council of State No. 17 and No. 18 of 2021 on concessions of State-owned maritime, lakeside and waterway property used for touristic and recreational purposes unduly borrow from the Constitutional Court some of its tools and remedies, such as the “counter-limits” and the limitation of temporal effects of its judgments. In its conclusions, the essay points out that the parallelism between the administrative judge and the Constitutional Court has been always present, even if dormant, in the Italian legal system.

Il contributo si sofferma criticamente sulla circostanza che le due sentenze gemelle dell’Adunanza plenaria sulle concessioni balneari n. 17 e n. 18 del 2021 prendano indebitamente in prestito dalla Corte costituzionale alcuni suoi strumenti, e in particolare i controlimiti e la limitazione degli effetti temporali delle proprie decisioni. Nelle conclusioni il contributo ricorda come il parallelismo tra i due organi – la Corte costituzionale e il giudice amministrativo – sia un elemento da sempre presente, anche se spesso latente, nel nostro ordinamento.
