The Constitutional Court (decision 127/2020) ruled on legitimacy to contest the son’s acknowledgement by the person who made it being aware of its untruthfulness. The issue is to identify – in the light of a constitutionally orientated interpretation – the right balance between the biological truth and the interest of the child. The Constitutional Court stated that it is an assessment in the hands of the judge case-by-case, having particular regard to the right to personal identity guaranteed by Article 2 of the Constitution.
