The issue of fake news, emerged in 2016 following the Brexit vote and the election of Donald Trump as United States president, concerns the bases of constitutionalism, involving the interpretation of Article 21 of the Italian Constitution and the other normative provisions governing freedom of information. Considering the recent laws promulgated by government to combat the fake news during the COVID-19 pandemic, this study aims to answer some questions: whether legal system is able to prevent the spread of fake news; whether the fake news can affect civil liberties (especially in situations where they are used as propaganda tools, in the political debate or in the decision making processes); whether there should be an appropriate law that governs this matter in order to tackle the problem, even accepting the risk of limiting the freedom of speech.
La questione delle fake news, esplosa nel 2016 con la Brexit e l’elezione di Donald Trump alla presidenza degli Stati Uniti, tocca le radici del costituzionalismo, chiamando in causa l’interpretazione dell’art. 21 della Costituzione e delle ulteriori norme che nell’ordinamento regolano la libertà di informazione. Anche alla luce delle più recenti misure adottate dal Governo per fronteggiare le fake news durante la pandemia da COVID-19, attraverso il presente contributo si intende rispondere ad alcuni interrogativi: se l’ordinamento presenti gli anticorpi necessari a contrastare la diffusione delle fake news; se le fake news siano in grado di incidere sulle libertà dei cittadini (specie quando vengono utilizzate come strumenti di propaganda, nel dibattito politico, o nei processi decisionali); se, al fine di contrastare il fenomeno delle fake news, sia auspicabile l’introduzione di una puntuale regolazione della materia, anche a costo di correre il rischio di limitare di fatto la libertà di manifestazione del pensiero.
