The article takes into consideration the state of the art of surrogacy in Italy. Two different ways of observing at the phenomenon emerged in the discussion. The first focused on the legislative ban in Law 40of 2004 with the aim of amending its content. The second instead concentrated on the recognition of the child born abroad following a surrogacy agreement. This jurisprudence was influenced by the rulings of the ECHR which first recognized the link with the biological parent and then required a form of protection also for the intended parent. The Constitutional Court's judgment no. 33 of 2021, which warned the legislature to intervene in this area as soon as possible, has opened up a new opportunity of reflection. The article highlights the differences between surrogacy and Assisted reproductive technologies and suggests possible measures to regulate the adoption of children born through surrogacy. In the light of the results of the case law and inspired by doctrine, it is argued that, in a (possible) future legislative intervention, consideration should be given both to the child's right to know his or her origins and to the pregnant woman's right to maintain a relationship with the child.
Il contributo prende in esame lo stato dell’arte della gestazione per altri in Italia. Nella trattazione sono emersi due diversi modi di guardare al fenomeno. Il primo si è focalizzato sul divieto contenuto nella legge 40 del 2004 mirando a modificarne il contenuto. Il secondo, invece, si è concentrato sul riconoscimento del minore nato all’estero in seguito ad un accordo di gestazione per altri. Tale filone è stato influenzato dalle pronunce della Corte Europea dei Diritti dell’uomo la quale ha dapprima riconosciuto il legame con il genitore biologico e successivamente ha richiesto una forma di tutela anche per il genitore intenzionale. In questa cornice si inserisce anche la sentenza n. 33 del 2021 della Corte costituzionale il cui monito rivolto al Legislatore di intervenire al più presto nella materia, ha dischiuso una nuova possibilità di riflessione per il giurista. Nell’articolo, mettendo in luce le differenze tra la pratica della gestazione per altri e la procreazione medicalmente assistita, si suggeriscono possibili interventi per regolare i casi di adozione dei figli nati da gestazione per altri. Fermo restando i risultati dell’elaborazione giurisprudenziale e prendendo spunto dall’elaborazione dottrinale, si è sostenuto come, in un (eventuale) futuro intervento legislativo, si debba considerare tanto il diritto del figlio a conoscere le proprie origini, quanto il diritto della gestante a mantenere una relazione con il minore.
