In December 2008, the Federal Republic of Germany instituted proceedings before the International Court of Justice in the Hague, alleging that the Italian Republic infringed and continues to infringe, through its judicial practice, the sovereign rights of Germany under international law. The controversy concerns, in particular, the existence under customary international law, of the rule which protects sovereign states from being sued before the jurisdiction of another state and the related rights of sovereign immunity.
