L’attuazione (solo parziale) del principio della libertà di prestazione dei servizi ai trasporti marittimi tra stati membri in Croazia — The (limited) application of the principle of freedom to provide services to maritime transaport between member states in Croatia

The essay describes Regulation (CEE) n. 3577/1992 on maritime cabotage and analyzes its enforcement in EU Member States, also on the basis of the interpretation given by the EU Commission. It especially sheds light on the transposition of the Regulation in Croatia, that took place in 2017, through amendments to the Maritime Code, the Regulation on the conditions for carrying out maritime cabotage in the Republic of Croatia and the Law on liner shipping and occasional coastal traffic. The essay eventually identifies some possible conflicts between the latter and Regulation (CEE) n. 3577/1992, which may result in violations of the principle of freedom to provide maritime transport services within member States, also in the light of the EU Court of Justice case law.
