Embrio-adozioni: A Brave New World?

The study starts by observing the gap on the regulation of the spare embryos. The progressive increase in the number of these biomaterials forces the scholar to identify possible solutions. There are two ways of using them that have galvanised the experts, the National Bioethics Committee and the Commission for the Study of Cryopreserved Embryos: the scientific research for therapeutic purposes and the embryo-sharing. The last, which is indeed widespread in many countries, has received many endorsements, but still lacks a legal framework and practical applications, as in the United States. Here the author investigates the applications received elsewhere and the obstacles to its implementation in Italy.

Lo studio muove dalla constatazione di un’ampia lacuna normativa in ordine all’impiego degli embrioni prodotti in vitro ed abbandonati. Il progressivo aumento dei c.d. spare embryos costringe l’interprete ad individuare soluzioni possibili. Due sono le modalità di impiego che hanno polarizzato gli interpreti, il Comitato Nazionale per la Bioetica e la Commissione di studio degli embrioni crioconservati: la destinazione alla ricerca scientifica con finalità terapeutica e l’Adozione per la nascita. L’embryo-sharing, diffuso per vero in molti paesi, ha ricevuto numerose adesioni, tuttavia difetta ancora una sua regolamentazione ed una applicazione prasseologica, come accaduto negli Stati Uniti. Per tali ragioni, si investigano le applicazioni ricevute aliunde e gli ostacoli alla sua implementazione in Italia.
