This article focuses on the EU law on energy communities (according to directive 2018/2001/EU to be transposed by 30 June 2021 and directive 2019/944/EU to be transposed by 31 December 2020) and its optimal transposition into Italian law. The aim of this paper is to highlight how the European Union intends to transform the European energy system not only thanks to new technologies and an overall reform of the EU energy law, but also thanks to the active citizenship of Europeans and their dual role as consumers and producers of energy. Indeed, the European Union and its Member States are betting on the ability of European citizens, united in specific business organizations (having as a primary purpose to provide environmental, economic or social community benefits for their shareholders or members or for the local areas where they operate, rather than financial profits), to lead our Europe faster towards more sustainable development.
Tema del presente scritto è la disciplina unionale delle comunità energetiche (composta dalla normativa delle comunità di energia rinnovabile contenuta nella direttiva 2018/2001/UE e dalla normativa delle comunità energetiche dei cittadini contenuta nella direttiva 2019/944/UE) e il suo recepimento ottimale nell’ordinamento italiano entro il 30 giugno 2021. Obiettivo del presente scritto è far emergere come l’Unione europea intenda trasformare il sistema energetico europeo non solo grazie alle nuove tecnologie e a una complessiva riforma del relativo diritto unionale (con tratti sia armonizzanti sia uniformanti), ma anche grazie alla cittadinanza attiva degli europei e al loro duplice ruolo di consumatori e di produttori di energia. In effetti, l’Unione europea e i suoi Stati membri scommettono sulla capacità dei cittadini europei – uniti in organizzazioni imprenditoriali con specifiche caratteristiche, attraverso le quali possa realizzarsi un’opportuna sussidiarietà orizzontale nel settore energetico – di condurre più celermente la nostra Europa verso uno sviluppo più sostenibile.
