I cinquant’anni della guerra dei sei giorni: alcune questioni (irrisolte) poste dalla risoluzione 242

Fifty years after the Six Day War, Resolution 242 continues to present ambiguities in interpretation and, by extension, problems in its implementation. This has led to the failure of any attempt to reach a final agreement between Israel and the Palestinian Authority and to a situation of no return caused by the settlements policy of Israel. The resulting demographic change in the Palestinian Occupied Territories has made de facto unachievable a comeback to the situation existing before the 1967. This prompts the question as if the principle of legality guaranteed by international law (ex iniuria ius non oritur) gave way to the principle of effectiveness (ex facto oritur ius).
