The article is an analysis of the decision n. 275/2017 of the constitutional Court on the so-called “deferred refoulement” (art. 10. 2, legislative decree n. 286/1998). Declaring the inadmissibility of the question, the decision seems to avoid the serious doubts of constitutionality regarding the violation of the rule of law and of the jurisdictional clause, as well as the violation of EU obligations. Nevertheless, the decision offers an interpretation in conformity of the Constitution of the provisions about the “deferred refoulement”, making a clear distinction between the two measures for its execution. So, the coercitive measure of removal to the border applies just in case of real urgency; in any other case, the measure applying is the order to leave the State’s territory within seven days. In addition, the decision address a warning to Parliament: the Court suggests that the provisions about the “deferred refoulement” executed by coercitive measure of removal to the border should be amended in conformity with art. 13.3 of Italy’s Constitution – thus implying the unconstitutionality of these provisions. Pending a future and uncertain legislative reform which will make constitutionally conform the “deferred refoulement” executed by coercitive measure of removal to the border, the “deferred refoulement” should be executed only through the order to leave the State’s territory.

L’articolo analizza contenuti ed effetti della sent. n. 275/2017 della Corte costituzionale sul respingimento differito disposto dal questore ai sensi dell’art. 10, co. 2, d.lgs. n. 286/1998. La sentenza dichiarando inammissibile la questione sollevata pare non pronunciarsi sulle importanti questioni di illegittimità costituzionale concernenti il respingimento differito per violazione delle riserve di legge e di giurisdizione e dei vincoli previsti dalle norme UE. Tuttavia essa compie una ricostruzione costituzionalmente conforme delle norme legislative sul respingimento differito e distingue tra le due modalità alternative per la sua esecuzione: la misura coercitiva dell’accompagnamento alla frontiera, da limitarsi ai soli casi di effettiva urgenza, e l’ordine del questore di lasciare entro 7 giorni il territorio italiano, da intendersi come sostitutivo dell’accompagnamento. Inoltre la sentenza rivolge al legislatore il monito di rendere conforme all’art. 13, comma 3 Cost. la vigente disciplina legislativa del respingimento differito da eseguirsi con accompagnamento alla frontiera, il che ne conferma l’incostituzionalità. Perciò il respingimento differito dovrebbe essere eseguito nella prassi soltanto con ordine di allontanamento e non con accompagnamento, in attesa di un futuro e incerto intervento legislativo che rimedi ai suoi tanti profili di illegittimità, senza il quale il respingimento differito sarà dichiarato incostituzionale da una nuova sentenza della stessa Corte.
