The article consider the evolution of the concept of "considerations of humanity" and its use by the International Tribunal for the Law of the Sea in order to fill gaps in the current international legal regime applicable to humans at sea and ensure their protection. Particular attention is devoted to the Enrica Lexie case, drawing lessons from the use of "considerations of humanity" in a case that, for the first time, opposes the rights of the two parties, instead of the rights of one party only.
