This doctoral research lies within the field of administrative law, specifically public procurement law, and aims to analyse the role of public procurement as a driver of innovation. The study begins by reconstructing the legal and conceptual framework of innovation — both as a means and as an end — and explores its legal, economic, and institutional implications within administrative action. Starting from the European framework established by Directive 2014/24/EU, the research examines the evolution of innovation procurement in Italy, focusing on the new Public Contracts Code (Legislative Decree No. 36/2023), which, although lacking an explicit definition of “innovation,” implicitly recognises it as a guiding principle of the system. The analysis investigates the main instruments of innovative procurement: the pre-commercial procurement (PCP), conceived as a co-funding mechanism for research and development, and the innovation partnership, designed to support the subsequent commercialisation of innovative solutions. Other flexible instruments — such as preliminary market consultations, the competitive dialogue, and the competitive procedure with negotiation — are also examined. The findings reveal that, despite their strong potential, innovative procurement procedures remain underused, mainly due to cultural resistance, information asymmetries, and a pervasive defensive bureaucracy driven by the fear of litigation and an excessive focus on self-protection rather than results. The study therefore highlights the need for a cultural and organisational transformation of the public administration, fostering risk management, professionalisation of contracting authorities, and the development of a genuine public innovation culture. A comparative insight into the Swiss experience illustrates an alternative approach in which the State acts primarily as a facilitator of innovation rather than a direct actor. Ultimately, the research demonstrates that innovation procurement should not be viewed as a mere procedural variant but as a new paradigm of administrative action, capable of integrating legality, efficiency, and technological progress, and of placing innovation at the core of contemporary public governance.

La presente ricerca si colloca nell’ambito del diritto amministrativo e, in particolare, del diritto dei contratti pubblici, con l’obiettivo di analizzare il ruolo degli appalti pubblici come strumento di promozione dell’innovazione. L’indagine prende avvio dalla ricostruzione del concetto di innovazione nella sua duplice dimensione — come mezzo e come fine — e ne approfondisce le implicazioni giuridiche, economiche e istituzionali all’interno dell’azione amministrativa. A partire dal quadro europeo delineato dalla Direttiva 2014/24/UE, il lavoro esamina l’evoluzione del procurement innovativo in Italia, soffermandosi sul nuovo Codice dei contratti pubblici (d.lgs. n. 36/2023), che, pur non fornendo una definizione esplicita di “innovazione”, ne riconosce la portata di principio generale. L’analisi si concentra sugli strumenti più rappresentativi del procurement innovativo: l’appalto pre-commerciale, concepito come meccanismo di cofinanziamento della ricerca e sviluppo, e il partenariato per l’innovazione, che consente la commercializzazione dei risultati ottenuti. Accanto a essi, sono esaminate le consultazioni preliminari di mercato, il dialogo competitivo e la procedura competitiva con negoziazione, quali strumenti di flessibilità contrattuale. La ricerca evidenzia come, nonostante l’elevato potenziale degli appalti innovativi, il loro impiego resti limitato a causa di resistenze culturali, asimmetrie informative e della diffusa burocrazia difensiva, alimentata dal timore del contenzioso e dal prevalere di logiche di autotutela. Si sottolinea, pertanto, la necessità di una profonda trasformazione culturale e organizzativa dell’amministrazione, orientata alla gestione del rischio, alla professionalizzazione delle stazioni appaltanti e alla costruzione di una vera cultura dell’innovazione pubblica. Un confronto con l’esperienza svizzera consente di evidenziare un modello alternativo, in cui lo Stato svolge principalmente un ruolo di facilitatore e promotore dell’innovazione. In conclusione, il lavoro dimostra come gli appalti per l’innovazione non costituiscano una semplice variante procedurale, ma un nuovo paradigma dell’azione amministrativa, capace di coniugare legalità, efficienza e sviluppo tecnologico, ponendo l’innovazione al centro della funzione pubblica contemporanea.
