The thesis studies the problems faced by law – especially criminal law – due to the migration phenomenon. After an overview of the national legislation, the paper focuses on the types of offences included in T.U. Imm.(D.Lgs. 25 luglio 1998, n. 286) which describes an immigrant as an offender. The paper describes the law's peculiarities, issues, questions of constitutionality and its compatibility with the European directives.
