This is the Italian legal report to the European Union Fundamental Rights Agency for the research project on fundamental rights of persons with intellectual disabilities and persons with mental health problems. The report highlights definitions of mental health disorders and intellectual disabilities in the Italian legal system; anti-discrimination rules and preferential treatment arrangements, also with regard to the enactment of international and EU law; the main provisions on fundamental rights of persons with intellectual disabilities (rights to life, freedom from torture and exploitation, liberty and security, fair trial, privacy etc.); rules on involuntary placement and treatment, as well as competence, capacity and guardianship. At the request of the Agency, the report presents all available data and information in a clear, concise and neutral style, also providing links to sources, when available via Internet. The report is complemented with an Annex collecting detailed case law references and analysis.
