This paper wants to highlight the main phases that characterize the transition process in the United States, during which the President-elect prepares to take on the federal Administration from the incumbent one. In detail, after the 3rd November 2020 elections, the incumbent (and defeated) President Trump denounced massive fraud, filed many lawsuits and suggested misusing some institutional and formal devices for the ratification of popular vote, aiming to reverse the results at all costs. All the “obstacles” the President-elect has faced during the transition process give the Author the opportunity to analyse some topics (start of transition, canvassing of State results, election and vote of Great Electors, final ratification of results in Congress) that were taken until that moment for granted and never seriously questioned

Il presente articolo intende evidenziare le fasi principali che caratterizzano il processo di transizione, all’indomani delle elezioni presidenziali negli Stati Uniti d’America, tra il Presidente uscente e quello eletto. Nel dettaglio, a seguito delle elezioni del 3 novembre 2020, il Presidente in carica (e sconfitto) Trump ha denunciato brogli massicci, ha promosso numerosi ricorsi presso gli organi giurisdizionali ed ha suggerito che alcune procedure formali per la ratifica del voto popolare avrebbero potuto essere utilizzate per “rovesciare” il risultato finale. Gli “ostacoli” così frapposti alla transizione offrono l’opportunità di analizzare alcune questioni (inizio della transizione, certificazione dei risultati statali, elezione e voto dei Grandi Elettori, ratifica finale del risultato da parte del Congresso) che erano sempre state interpretate in modo pacifico e mai messe veramente in discussione.
