The thesis is focused on the role of the Court of justice of the EU in the development of the European cooperation in police and criminal matters (former Third Pillar of the EU). The first chapter analyses the novelties introduced by the Treaty of Lisbon and devotes a particular attention to the wording of articles 82 and 83 TFEU. The second chapter is centred on the functional aspects, that is to say the new shape and limits of the Court's jurisdiction after the entry into force of the Treaty of LIsbon. The analysis then moves to the role of the Court in safeguarding the correct exercise of EU competences. The final step relates to the interpretative role of the Court: stemming from the ordinary interprtative criteria used by the Court, the author investigates how the Court itself applies them in the field of cooperation in criminal matters. The European arrest warrant and the ne bis in idem principle are the main case-studies.
