The work analyses the main contracts and relationships between banks and costumers from the point of view of the issues concerning the information asymmetry, due to the specificity that characterises the activity of banks, and the unfairness conducts of banks. After a chapter dedicated to a short history of the Italian legislation concerning the relationship between bank and costumers, the work shows and makes reflections, thanks to a deep research in law in action, above the remedies that a costumer is able to use in Italian private legal system in order to deal with and defend from unfairness conducts coming from banks. Particular attention is given to good faith, as a principle integrative of contracts, to tort law, to law of contracts, especially as far as misrepresentation and Non disclosure is concerned.
