The basic notion related to CCI – Cultural & Creative Industries requires an in-depth consideration because, on the grounds of its quali-/quantitative contents, given their potential capacity of being industrialized, the consequence is that the economic factor (especially the occupation), the social quality progress and the human personality development may be more or less increased. One of the major issues dealt with by the economic doctrine of culture is, indeed, how CCI can be conceptually framed. Thanks to the findings here presented, the research contributes to the debate on the definition of CCI from a legal point of view. Due to the universal interest in such a notion, both the international and the European-EU systems have been used, alongside the internal one with a specific reference to the constitutional law. What makes the definition a unicum in the panorama of the multilevelled public law is the specific character of CCI, which, at the same time, investigates the profiles of “culture”, “creativity”, and of “industry/economy”. This also stands out in the Italian system, because the republican Constitution does not know that notion, which makes scholars give it a systematic interpretation. In addition to this, having to do with a form of regional State, we need to realise how competences between the State and the Regions are distributed, due to the heterogeneous sector of CCI.

Riflettere sulla nozione di base relativa alle «industrie culturali e creative-ICC» è fondamentale, perché, a dipendere dai contenuti quali/quantitativi di cui essa si sostanzia, vista la loro potenziale ‘industrializzabilità’, la conseguenza è che sia il fattore economico, quello dell’occupazione in particolare, sia il fattore di progresso della qualità sociale e sviluppo della personalità umana potrebbero venire più o meno incrementati. Quello dell’inquadramento concettuale delle ICC è un problema di cui s’è occupata soprattutto la dottrina economica della cultura. Con i risultati della ricerca che qui si presentano si offre un contributo al dibattito relativo alla definizione delle ICC da un punto di vista giuridico. A tal riguardo, siccome siamo difronte ad una nozione di interesse universale, ci si è avvalsi tanto dell’ordinamento internazionale, quanto di quello dell’UE, quanto, infine, di quello interno con specifico riferimento al diritto costituzionale. La specificità delle ICC - che, ad un tempo, interpella sia il profilo della «cultura», sia il profilo della «creatività», sia il profilo dell’«industria/economia» -, fa della definizione di questa nozione un unicum nel panorama del diritto pubblico multilivello. E lo si vede anche nell’ordinamento italiano, non soltanto perché si tratta di una nozione sconosciuta alla Costituzione repubblicana, che impone allo studioso un’interpretazione di tipo sistematico, ma anche perché, trovandoci difronte ad una forma di Stato regionale, si pone la necessità di comprendere come sia avvenuta la distribuzione delle competenze tra lo Stato e le Regioni dell’eterogeneo settore delle ICC.
